GeM bid 'Not Evaluated': what it means and what to do next
The short answer
"Not Evaluated" on GeM means the buyer's evaluation recorded no decision on your bid. It is not a finding that your documents failed, and GeM itself does not evaluate bids. Raise a representation from the bid listing page within 48 hours of the result, ask the buyer in writing for the reason, and keep proof of every step.
Key takeaways
- GeM's own user manual says a bidder that is not evaluated is simply displayed as "Not Evaluated"; the buyer runs the evaluation, not GeM.
- The representation option sits on the bid listing page and, per GeM's manual, stays open for 48 hours from publication of the result.
- A good representation asks for reasons and points to what you already uploaded; new documents sent with it are usually refused.
- In 2024 the Delhi High Court held that a bidder marked "Not Evaluated" was entitled to know why, and ordered a reasoned decision within two weeks.
What does "Not Evaluated" mean on GeM?
You open the seller dashboard, find the bid, and the technical status column says "Not Evaluated". No reason, no remark. It is a strange thing to read after a week of preparing documents.
GeM's user manual for single packet bids (opens in a new tab).pdf) (para 4.15) is plain about it: the system updates the status of each bidder the buyer evaluates, and a bidder that is not evaluated is displayed as Not Evaluated. In other words, the label records the absence of a decision. It does not say your bid failed a clause.
The decision belongs to the buyer. A GeM notice on its role in e-bidding (opens in a new tab) states that "There is no role of GeM in Bid evaluation process", and that under the GeM terms the buyer decides the technical and commercial acceptability of each bid. The buyer may evaluate alone, or assign the bid to technical evaluators and a tender committee, as GeM's technical evaluator manual (opens in a new tab) describes.
Not Evaluated vs Disqualified vs Qualified: reading your GeM bid status
The three outcomes call for different responses, so read the status carefully before you reply to anyone.
| Status you see | What it records | Your next step |
|---|---|---|
| Qualified (technically suitable) | The evaluator accepted your offer against the bid conditions. | Prepare for financial opening or a reverse auction, if the bid has one. |
| Disqualified, with a reason | The evaluator rejected your offer and recorded why. | Compare the reason with the bid document and your upload. If it is wrong, file a representation in the window. |
| Not Evaluated | No technical decision was recorded against your bid. | File a representation asking for the reason, and write to the buyer. |
If your bid was disqualified with a stated reason, the causes are usually the ordinary ones: documents, eligibility, a missed ATC condition. Our list of tender rejection reasons helps you check whether the reason holds before you contest it.
Why would a GeM bid be marked Not Evaluated?
GeM does not publish a list of causes, and the status carries no reason field. From GeM's manuals and the court records, these situations fit:
- Single packet bids. The manual says all bids are considered for evaluation based on their ranking at opening, and the buyer evaluates alone. A buyer who settles on a suitable offer near the top may never record a decision against bids further down.
- Bulk marking without recorded reasons. In the 2024 Delhi High Court case below, 227 of 237 bidders received the identical remark, and the authority told the court it was unaware of how the remark was assigned.
- Something only the buyer can explain, such as an evaluation closed early or a technical error on the buyer's side.
Whatever the cause, the status itself will not tell you. That is why the next two steps, the representation and a written request, matter more than guessing.
GeM representation: the 48-hour window
GeM gives sellers one built-in route to challenge the buyer. Section 5 of the single packet bid manual sets out how it works:
- Once the buyer confirms and notifies the bidders, the results become publicly visible.
- You can view the technical status of each bid you joined, and challenge the buyer's decision with the representation option on the bid listing page.
- The time available is 48 hours from publication of the bid result.
- You enter a description, can upload supporting documents, and can later see the history of your representation.
- The buyer views each representation under its review section and accepts or rejects it.
- The buyer must address all representations raised against disqualification before it can create the order.
On the buyer's side, the technical evaluator manual lists a separate queue of bids where "a challenge rejection is raised by the bidder", so a representation goes back to whoever evaluated the bid.
How to write a GeM representation that gets an answer
A representation is not a second bid. Evaluators read it to decide whether they missed something, so give them a short, checkable note.
- Ask for the reason first. For a Not Evaluated status, the core request is that the buyer evaluate the bid or record why it did not.
- Point to what you already uploaded: the file name, the page and the bid clause each document answers.
- Do not use the window to add new credentials. The central Goods Manual (para 7.3.5) allows buyers to take only documents that existed at bid opening, and in May 2025 the Delhi High Court upheld a disqualification where the bidder had sent a fresh CA certificate with its representation.
- Stay polite and specific. A note that cites clauses gets forwarded; a note that threatens gets filed.
What GeM does and does not handle
Sellers lose days writing to the wrong desk. The GeM notice says GeM will not entertain representations on the process of bid evaluation, advises buyers not to seek its opinion on them, and adds that it is neither audit nor vigilance for buyers.
| Problem | Who decides | Where to go |
|---|---|---|
| Your bid was not evaluated, or the reason is unclear | Buyer | Representation in the window, then a written request to the buyer |
| A buyer ATC condition you think was applied wrongly | Buyer | Representation citing the ATC clause; see ATC in GeM |
| The portal would not let you upload or file | GeM | GeM support, with screenshots and timestamps |
| Reviewing the buyer's evaluation decision | Not GeM | GeM says it cannot be made a party to examining such representations |
| No reply and a large contract at stake | High Court | Writ petition, on legal advice |
How to ask the buyer for the reason after the window closes
Missing the 48 hours does not end your right to ask. Write to the buyer by email or letter, using the contact in the bid document. Quote the bid number, the status and the date you saw it, and ask for the specific reason and the clause it relates to. Keep the sent copy.
This is what the petitioner did in JBMD Enterprises v. Sr Dy. CGDA, a GeM bid for security services decided by a Delhi High Court division bench on 1 June 2024, as reported by SCC Online (opens in a new tab). It wrote seeking reasons the day after the results and got no reply. The court found the tendering authority and GeM were "passing the buck", held that the bidder was "entitled to know the reasons for the disqualification of its bid", and directed them to pass a speaking order within two weeks.
A court route costs time and money, and it is worth it only on bids that matter. But a dated written request is cheap, and it is the first thing any lawyer will ask you for.
Illustrative example: a Pune lab glassware supplier
A small Pune firm bids on a GeM tender for borosilicate glassware worth about Rs 9 lakh for a university lab. On Thursday at 6 pm, the result shows its status as Not Evaluated, with two other bidders qualified.
On Friday morning the sales head files a representation. It lists the OEM authorization, the test certificate and the past order, each with file name and page, and asks the buyer to evaluate the bid or record why not. It adds nothing new. The same day, a letter goes by email to the buyer quoting the bid number.
On Monday the buyer replies that the bid was missed when evaluating in rank order, evaluates it, and finds the offered pack size short of the specification. The firm is disqualified, this time with a reason it can check, and it updates its catalog listing for the next bid. Names, values and the outcome are illustrative.
How AI tools help with GeM bids, and what your team decides
A representation written in two working days is only as good as your record of what you uploaded and why. TenderGenie Document Intelligence brings requirements and clauses out of a bid document and its ATC with a reference to the source page, so your note can cite the exact condition rather than paraphrase it.
Before you bid, Risk & Compliance compares the stated criteria with your organization's credentials and documents and flags gaps. In Collaboration, tasks, queries and approvals sit in one shared workspace with an audit trail, which helps when a representation needs a quick sign-off.
Your team still decides whether to file a representation, what tone to take with a buyer you want to keep, and when a bid is worth legal advice. TenderGenie does not file representations or contact buyers for you.
Questions and answers
What does Not Evaluated mean in a GeM bid?
It means the buyer's evaluation recorded no technical decision on your bid. GeM's manual says a bidder that is not evaluated is displayed as Not Evaluated. It does not mean your documents were found deficient, and it does not come from GeM, because the buyer carries out the evaluation.
Is Not Evaluated the same as disqualified on GeM?
No. A disqualified bid has been examined and rejected, and the buyer should record a reason. A Not Evaluated bid has no recorded decision. In practice both keep you out of the next stage, so ask for the reason either way through a representation and a written request.
How do I raise a representation on GeM?
Open the bid listing page in your seller account after the result is published and use the representation option against the bid. Enter a short description, attach supporting documents if needed, and submit. You can later view the representation history, and the buyer accepts or rejects it from its review screen.
What is the time limit for a GeM representation?
GeM's single packet bid manual gives 48 hours from publication of the bid result. Check the technical status of every open bid daily, because the window can close over a weekend. After it closes, you can still write to the buyer directly and ask for the reason.
Can I upload new documents with a GeM representation?
You can attach documents, but buyers usually refuse new credentials. Central procurement rules allow a buyer to take only documents that existed at bid opening, and a 2025 Delhi High Court judgment upheld a disqualification where a fresh CA certificate was sent with the representation. Point to what you already uploaded instead.
Will GeM review the buyer's decision if I complain?
No. GeM has said it has no role in bid evaluation, will not entertain representations on the buyer's evaluation, and is neither audit nor vigilance for buyers. Raise evaluation issues with the buyer. Contact GeM support only for portal problems, such as a representation option that does not work.
Can I go to court if my GeM bid is marked Not Evaluated?
Yes, through a writ petition in the High Court, on legal advice. In 2024 the Delhi High Court directed a buyer and GeM to give reasons and pass a speaking order for a bidder marked Not Evaluated. Courts look for your written requests first, so send one early.
